Incorporated Trustees of HEDA Resource Centre v. Attorney General of Federation Suit No: FHC/L/CS/532/18

This suit was instituted at the Federal High Court, Lagos before Justice M.B Hassan of Court 11 by the Incorporated Trustees of HEDA Resource Centre against the Attorney General of Federation seeking for the court’s declaration that the grant of the OPL 245 licence to Malabu Oil and Gas Ltd was unconstitutional and illegal and as such it could not have been lawfully held or transferred by Malabu Oil and Gas Ltd.

HEDA is also seeking for an order of mandamus directing and or compelling the respondent to revoke the Operating Production Licence (OPL) 245 on grounds that the entire Malabu transaction in relation to the OPL 245 was unconstitutional, illegal and void as it was not legally granted, same having been obtained fraudulently vide corrupt practices.

The court has already heard and granted leave to HEDA Resource Centre to file the originating motion. There are also indications of interest from some interested parties such as Nigerian Agip Exploration Limited and Shell Nigeria Exploration Production Limited. The suit has thus been adjourned to the 4tn day of October, 2018 for hearing of all applications for joinder of parties.
